By accessing or using Back On Market Docs ("Service", "Platform", "we", "us", "our"), you agree to be bound by these Terms & Conditions. 2. Our Mission: Transparency & Empowerment

Back On Market Docs exists to bring transparency and honesty to real estate transactions. We believe that property reports—including home inspections, appraisals, sewer scopes, and other professional assessments—should be accessible and reusable, not locked away after a single use.

When you purchase a report through BOMDocs, you own it. This means:

• You can view, download, and use the report for your own purposes
• You have the right to share the report with trusted advisors (realtors, attorneys, contractors)
• You can use the report to make informed decisions about your real estate investment
• The information belongs to you, not hidden behind paywalls or lost after a transaction

What are you going to do with it? Invest it! Every report you purchase is an investment in transparency, knowledge, and smarter real estate decisions. By pooling these reports in our marketplace, we create a transparent ecosystem where information is shared, not hoarded.

3. Services Provided

Back On Market Docs provides a digital marketplace for professional real estate reports. Our services include:

• Report Marketplace: Browse, search, preview (watermarked), and purchase discounted real estate reports including home inspections, appraisals, sewer scopes, pest inspections, radon tests, and more.
• Upload & Earn: Licensed professionals can upload reports to earn commissions on future sales, creating a sustainable revenue stream for quality documentation.
• Referral Program: Earn referral fees when others purchase reports through your referral links.
• API Access: Developers can integrate BOMDocs reports into their own applications and platforms.
• Transparent Pricing: All reports are priced clearly, with commission structures visible to all participants.

4. User Accounts & Responsibilities

To use certain features of the Service, you must register for an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and update your account information to keep it accurate
• Keep your password secure and confidential
• Notify us immediately of any unauthorized access or use of your account
• Be responsible for all activities that occur under your account
• Comply with all applicable laws and regulations in your use of the Service

We reserve the right to suspend or terminate accounts that violate these terms or engage in fraudulent, abusive, or illegal activity.

5. Report Purchases & Licenses

Purchase Rights

When you purchase a report through BOMDocs:

• You receive a single-user license to view and download the full PDF report
• The report is tied to your account and accessible through your dashboard
• You may share the report with trusted parties involved in your real estate transaction (your realtor, attorney, contractor, lender)
• You may use the information contained in the report to make informed decisions about properties

Usage Restrictions

You may NOT:

• Resell or redistribute the report for commercial gain without permission
• Upload the report to other platforms or marketplaces
• Remove watermarks or attempt to circumvent security measures on preview versions
• Use the report for any illegal or fraudulent purpose
• Modify or alter the report content in a way that misrepresents the original inspector or findings

Report Accuracy & Disclaimer

Reports are created by third-party licensed professionals (inspectors, appraisers, contractors). BOMDocs does not verify, edit, or guarantee the accuracy, completeness, or suitability of any report. Reports reflect conditions at the time of inspection and may not reflect current property conditions. Always consult qualified professionals for current assessments.

6. Payments, Pricing & Commissions

All transactions are processed in U.S. Dollars (USD). Payment is required at the time of purchase via our secure payment processor (Stripe). We accept major credit cards and debit cards.

Pricing Transparency

Report prices are set by uploaders and are displayed clearly before purchase. Prices may vary based on report type, property location (Utah, and expanding to other U.S. states), and market conditions. We are committed to keeping prices transparent and fair.

Commission Structure

When you upload a report that is purchased by others, you earn a commission. Commission rates are visible in your dashboard and may vary based on your role (Uploader, Realtor, Partner). We reserve the right to adjust commission structures with 30 days' advance notice to affected users.

Refunds

Due to the digital nature of our reports, all sales are final once a purchase is completed and the report is accessible. Refunds may be considered on a case-by-case basis for technical issues or errors in report delivery. Contact us at support@bomdocs.com to request a refund review.

7. Intellectual Property Rights

Report Content Ownership

The original creator or uploader of a report retains intellectual property rights to the report content. By uploading a report to BOMDocs, uploaders grant BOMDocs a non-exclusive, worldwide license to host, display, and distribute the report through our marketplace.

Platform Content

All content on the BOMDocs platform—including website design, logos, text, graphics, software, and documentation—is owned by Back On Market Docs or our licensors and is protected by U.S. and international copyright, trademark, and other intellectual property laws.

User-Generated Content

You retain ownership of content you upload (reports, reviews, comments). By uploading content, you grant BOMDocs a license to use, display, and distribute that content as necessary to provide our services.

8. Prohibited Uses

You agree NOT to use the Service to:

• Violate any local, state, national, or international law or regulation
• Infringe upon the intellectual property rights of others
• Upload false, misleading, or fraudulent reports
• Impersonate another person or entity
• Interfere with or disrupt the Service or servers
• Attempt to gain unauthorized access to any portion of the Service
• Use automated systems (bots, scrapers) to access the Service without permission
• Upload malicious software, viruses, or code
• Harass, abuse, or harm other users
• Collect or harvest information about other users without consent

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability, fitness for a particular purpose, or non-infringement
• Warranties that the Service will be uninterrupted, secure, or error-free
• Warranties regarding the accuracy, reliability, or quality of any reports or content
• Warranties that defects will be corrected

BOMDocs does not warrant that reports are accurate, complete, current, or suitable for your specific needs. Reports are professional assessments made at a specific point in time and may not reflect current property conditions. Always verify information independently and consult qualified professionals.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BACK ON MARKET DOCS, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, use, goodwill, or other intangible losses
• Damages resulting from your use or inability to use the Service
• Damages resulting from any reports, content, or information obtained through the Service
• Damages resulting from unauthorized access to or alteration of your data

Our total liability to you for all claims arising from or related to the Service shall not exceed the amount you paid to BOMDocs in the 12 months preceding the claim, or $100, whichever is greater.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

11. Indemnification

You agree to indemnify, defend, and hold harmless Back On Market Docs, its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or relating to:

• Your use or misuse of the Service
• Your violation of these Terms & Conditions
• Your violation of any third-party rights
• Content you upload or post on the Service
• Any reports you upload that are false, misleading, or infringe upon others' rights

12. Governing Law & Dispute Resolution

These Terms & Conditions are governed by and construed in accordance with the laws of the State of Utah, United States, without regard to its conflict of law provisions. If you are located outside the United States, these terms are governed by U.S. federal law and the laws of Utah.

Any disputes arising from or relating to these terms or the Service shall be resolved through binding arbitration in Salt Lake County, Utah, in accordance with the rules of the American Arbitration Association. You waive your right to a jury trial and to participate in class actions.

If any provision of these terms is found to be unenforceable, the remaining provisions shall remain in full effect.

13. Changes to Terms

We reserve the right to modify or replace these Terms & Conditions at any time. If we make material changes, we will notify you by:

• Posting the updated terms on this page with a new "Last updated" date
• Sending an email notification to registered users (if changes are significant)
• Displaying a notice on the Service

Your continued use of the Service after changes are posted constitutes acceptance of the new terms. If you do not agree to the changes, you must stop using the Service and may close your account.

We reserve the right to suspend or terminate your access to the Service at any time, with or without cause or notice, for any reason including but not limited to:

• Violation of these Terms & Conditions
• Fraudulent, abusive, or illegal activity
• Requests by law enforcement or government agencies
• Extended periods of account inactivity

You may close your account at any time through your account settings or by contacting us. Upon termination, your right to use the Service will immediately cease. Reports you have purchased will remain accessible to you, but you will no longer be able to upload new reports or earn commissions.
